This presentation summarizes and illustrates some of the current legal trends regarding the First Amendment rights of sexual minority youth and their supporters as well as those students opposed to homosexuality. There can be no mistake – discussion of sexual orientation – particularly in the context of public schools – is a core “culture wars” issue. While the “text” of these discussions is constitutional law, the “subtext” is often broader social policy about civil liberties in the schoolhouse, in the parent trap, and even at the marriage altar. In this presentation, we will do our best to remain faithful to the text.
